Legal Basis for Using Public Data and Terms
Decree No. 8,777/2016 - Open Data Policy of the Federal Executive Branch:
This decree establishes the Brazilian government's Open Data Policy, promoting the free use of public data and encouraging the creation of tools that expand citizens' access to government information. According to the decree, data and information about government programs can be used independently by society, as long as transparency is ensured (Decree nº 8,777/2016).
Decree No. 9,903/2019, Article 4 - Free Use of Public Databases:
This article determines that the databases and information that make up the federal government's active transparency policy are freely available for public use and can be used for informational and educational purposes, without restrictions. In this way, it guarantees that data and information about “DETRAN” can be accessed and presented in an informative way by third parties, such as in independent applications (Decree nº 9,903/2019, Article 4).
Copyright Law (Law No. 9,610/1998):
The Copyright Law, in its Article 7, Item XIII, allows the public use of compilations of data and information owned by the Federal Government, including data available on official government portals. This use is authorized for transparency and educational purposes, as long as it does not falsely imply an official affiliation (Law nº 9,610/1998).
